SALES  TAX  INFORMATION:

California: California may require that we collect 9.75% sales tax on items shipped into California from a California warehouse. Even though our business is in Kentucky we have business relationships with distributors that have facilities in California. Depending upon the product and a destination address of California we have to assess all sales to California a sales tax. If we are able to circumvent this tax we will do so and refund the assessed tax amount at time of shipment. This amounts to taxation without representation for businesses such as ours that are not located in California. If you live in California and do not think this is fair please contact your elected state officials. This taxation also violates federal interstate trade regulations but we are unable to stop California at this time until this issue is resolved in federal court.

Colorado: 2010: Colorado law now states: “The purchaser is required to file annually a sales/use tax return with Colorado Department of Revenue and pay tax on those purchases on which the resident has not paid sales tax; that the seller will provide them a year end summary of the purchases he/she made on which sales taxes were not collected; and that the law requires the seller to provide the Colorado Department of Revenue an annual report on the total amount of all the purchaser’s purchases on which sales tax was not collected.” It is unclear what effect this law will have on our deliveries to Colorado. It would require our company to provide Colorado with all names, addresses, items, and costs for products delivered to Colorado. This provision will be challenged in federal court soon. Please contact your elected state officials to have this burdensome law repealed.
